Roundup City Council Agenda

MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROUNDUP HELD ON SEPTEMBER 6, 2022 AT 7:00 P.M. IN THE CITY COUNCIL CHAMBERS AND GOTO MEETING.The meeting was called to order by Mayor Jones. Clerk/ Treasurer Lanter conducted roll call with council members, Long, Liggett, Erickson, Carlson, Toombs, and Fisher present. Also, present were Director Sibley and Assistant Clerk Mann. Attorney Brooks was present by video. Vivirito and McCleary were absent. MOVED BY FISHER SECONDED BY TOOMBS TO APPROVE THE MINUTES OF THE AUGUST 16, 2022 MEETING. ALL IN FAVOR. MOTION CARRIED.MOVED BY CARLSON, SECONDED BY TOOMBS TO APPROVE THE AGENDA ADDING; RESOLUTION #1167. ALL IN FAVOR. MOTION CARRIED.

Visitor: Jessica Howe with Archive Social- gave a presentation by video on protecting the city with social media archiving. A cloud-based solution. A handout was given to the council. Cost is $3,588.00 annually. It is not a contract.

Law Enforcement: Undersheriff Bednar gave Clerk/Treasurer a copy of call for service.

New Business: Public Hearing for Zoning Changes, 1st Reading of Ordinance #478-Close Regular meeting at 7:15pm and open Public Hearing. Jeremy Fadness- Planning Board had a hearing and recommended the city approve Ordinance #478. Public Comment- Theresa Doumitt asked if the only changes were on the Eastside? Yes, per Mayor Jones. Mayor Jones showed on the map where the changes will be made. Changing All lots within blocks 21, 22, 23, and 24 of the Roundup Park Addition from R2 to light industrial to match up with the rest of the lots zoned in that area.

MOVED BY TOOMBS, SECONDED BY LIGGETT, TO APPROVE FIRST READING OF ORDINANCE #478. ALL IN FAVOR. MOTION CARRIED. No public comment.

Close Public Hearing at 7:19pm and open regular meeting.

Public Hearing for ADA Stage Improvements, exemptions from MEPA-Close regular meeting at 7:19pm and open public hearing. Chad Hanson with Great West Engineering- Not changing footprint, paving existing area where gravel is. No public comment.

Close Public Hearing at 7:21pm and open regular meeting.

Mayor Jones:

• Coal Board meeting will be September 8th, Toombs and Chad Hanson will attend with Mayor. Will ask for funding for the stage.

• Deer Management Plan update: new map this season. Number of tags reduced since properties were removed from map.

• Meeting Dates: Next meeting will be held on Monday September 19th. October 4th meeting, Toombs will facilitate. Might go on vacation the week after.

• Kiosk buy sell agreement: Brent drew it up. Closing soon. Opening bids on Friday the 9th at 2pm for the project.

• Stockman Bar update: Abatement finished in August, was told Demolition would start in September. No cost to the city. Was told sale of property can go into TIF (Tax Increment Financing) District.

• Bruce had a question about a new home owner that already ordered a Conex container, is it ok for her to place on her property? Council has no problem with it. Attorney Brooks: Marijuana Ordinance revisions draft: Dispensaries are prohibited in Musselshell County and the City. Brent talked about MT HB 701. Mayor Jones read the ordinance draft aloud for the public. Will submit the ordinance to the Department of Revenue when finished. First reading at next meeting. Public Comment- Undersheriff Bednar- Who is going to enforce this ordinance? Bruce or Law enforcement? Attorney Brooks- We can add to the ordinance for Bruce to handle it, but it is a misdemeanor. Bednar said a vape shop is opening on Main St. would like 18.3 looked into as well. Mayor Jones will look at 18.3.

Correspondence: Tanya Lanter- Tree’s and Tacos, workshop on proper pruning and removal of trees. Tuesday September 20th at the fairgrounds.

Unfinished Business:

• Fireworks Ordinance: Mayor Jones- Will continue to work on it.

• MDT meeting Ad Hock Committee: Mayor Jones- Have not had a meeting yet. Brainstorm challenges, lets shoot for the first week in December.

• Mayor Jones- Jim Vivirito talked with the County Commissioners about pool funding. They aren’t interested in putting money into the pool, but are interested in a joint parks position.

Report out from Council Committee Meetings:

• Parks Committee: Mayor Jones-Parks Committee met tonight. Having two managers who did a great job made a big difference. Robin is sick tonight and couldn’t make it. Talked about the Pool Policy. Perhaps change lap swim/adult swim to 7:30am-9:00am and no-one under the age of 18yrs of age. Eliminate evening lap/adult swim. Also, only allowing pool toys that are appropriate for the pool. Mayor will work on the policy.

Director Sibley: Pipes in ground.

Council Action Items:

MOVED BY TOOMBS, SECONDED BY FISHER TO APPROVE RESOLUTION #1165. A RESOLUTION TO LEVY AND ASSESS PROPERTIES FOR UNPAID WATER, SEWER, AND SOLID WASTE UTILITY SERVICES IN THE CITY OF ROUNDUP, MONTANA. ALL IN FAVOR. MOTION CARRIED.

No public Comment. MOVED BY TOOMBS, SECONDED BY FISHER TO APPROVE RESOLUTION # 1166. A RESOLUTION ACCEPTING THE DETERMINATION THAT THE COMMUNITY STAGE ADA IMPROVEMENTS PROJECT IS CATEGORICALLY EXCLUDED EXEMPTED FROM MEPA REVIEW UNDER ARM 8.2.328(2). ALL IN FAVOR. MOTION CARRIED.

No public comment. MOVED BY TOOMBS, SECONDED BY CARLSON TO APPROVE RESOLUTION #1167. A RESOLUTION THAT AUTHORIZES THE CITY OF ROUNDUP TO ACCEPT AND RECEIVE THE TRANSFER OF PROPERTY DESCRIBED AS ROUNDUP ORIGINAL TOWNSITE, S13, R25E, BLOCK 27 LOT 17 AS A DONATION TO THE CITY OF ROUNDUP. ALL IN FAVOR. MOTION CARRIED. No public comment.

Public Comment: Bill Trent-What does a vote of initiation mean in the Marijuana Ordinance.

Mayor Jones- They must do a ballot initiative for the people to vote on.

Theresa Doumitt-Thanked the council for partnership and approving the Kiosk Ordinance.

Undersheriff Bednar- Haven’t received email with Brents contact info. Mayor will send it to Sheriff Lesnik and Undersheriff Bednar.
