MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROUNDUP HELD ON January 16, 2024 AT 7:00 P.M. IN THE CITY COUNCIL CHAMBERS.
The meeting was called to order by Mayor Jones. Clerk/ Treasurer Lanter conducted roll call with council members, Adams, Vivirito, Erickson, McCleary, and Fisher present. Also, present were, Director Sibley, Assistant Clerk Mann, and Compliance Officer Hoiland. Attorney Brooks was present by video. Long, Carlson, and Toombs were absent.

Law Enforcement: Bednar-Will get numbers to you next work week.

Mayor Jones:
• Housing Analysis Plan Grant-will provide a more detailed analysis and guidance of housing within the city. Montana is the second fastest growing state. Captures economic growth or decline. Good Grant, match of $6,000.00. Will validate why we are spending our time and investment in certain areas.
• Growth Policy Community Coffee- will be next Monday night, January 22nd at 6pm. @ the Senior Center.
• Wayfinding Signs-Morgan Belveal sent an email. 45 Banners are here. Lon said the city can help hang them. 5 place marker signs that will be installed at the City Park, Fair Grounds, Ice Cream Hill, River Walk, and Community Stage are in production, expect to have them early spring.
Attorney Brooks: Supreme Court addressing homeless and camping on sidewalks within city limits. It would be wise to keep track of case, perhaps put on hold or modify. Summer or fall decision from Supreme Court could impact ordinance.
Compliance: Hoiland- No new permits. Randy Hafer working on trying to get permits for central school.
Unfinished Business;
• CIP Capital Improvement Plan: Moved to action item.
• On Street Parking/Camper, RV discussion: Fisher-We should move forward, work on it so we are ready to go. Council good with it.
Report out from Council Committee Meetings:
• Refuse Board: Fisher-Previous employee terminated. Looking for new person. Coming up with new rules on handling money, along with new job descriptions. Hopefully have someone hired by the end of the month.
• Water Authority: Lanter- Wells 4 & 5 preconstruction. Start drilling March 1st. Completion May 1st. Phase 1 complete. Waiting on 7-meter pits. Phase 2a, 50% complete. 2b, all main line in. 2c, started fusing pipe.
• Wages & Salaries Committee Discussion: Fisher- I recommend 3.2% raise and upping hours to Bruce’s job as needed, this coming fall. Action item at next meeting.
Director Sibley: Few frozen homes. It’s the same ones every year. No Main breaks.

Law Enforcement: Undersheriff Bednar- Emailed report to the council. Fisher-Can the program tell us how many charges were in the city? Bednar- You will have to ask the County Attorney’s office for those numbers. I will see what I can do. Vivirito- How many calls for service? Bednar- I sent it in a second email.

Visitors: Theresa Doumitt-Open house for the Welcome Plaza/Kiosk will be April 20th at 9:45. We will do a ribbon cutting for Gregs mural before. Will have plaques to recognize 45 partners. Did a walk through with Lee and Clint, they were happy with everything. Closed out with contractor.
It’s our 6th year we have participated in the MUD Drive. Received $980.00 in donations from the community.
We are recommitted to revamping the playground equipment at the Central School.
Theresa read a text from Randy Hafer.
Mayor Jones:
• Received signed document from Veterans. Park Committee will consult with Veterans group with any questions or concerns with the Memorial Park.
• Cody Marxer is leaving Great West March 31st. We will be assigned a new planner.
• Took a tour last Friday with County Commissioners of projects around town. (Wier Building, Kiosk, Central School, and Homes on the Range).
• Will attend the Executive Forum in Sidney, February 27th through March 1st.
• Will have eye surgery March 20th. Gary will hold down the helm, with Floyd’s help.
• Porche Car Glub is planning a visit to Roundup this summer. 70 cars total. Not a car show. Would like to welcome them, perhaps give them the key to the city. Will keep the Council posted.
• March 12th, Brent invited Bruce and I to Harlowton, to chat about Code Enforcement issues.
Attorney Brooks:
• On street parking ordinance #482: Have not finished it yet. Will have it at next meeting.
• Code Enforcement: March 12th will attend the Council Meeting in Harlow with Bruce and the Mayor. Tina, Code Informant Officer from Billings will attend. Feel free to get questions to me before the meeting and I will get it to her.
Compliance: Hoiland- Four permits issued. Derek Jones called about the Hafer projects. No permit has been applied for. We are to do nothing more until he has a permit in hand.
Unfinished Business;
• Subdivision Regulations: Goes to Planning Board next month.
• Green Oil Field Subdivision: Will be reviewed at the same time as the Subdivision Regulations.
• Central School site plan, amend plat, donation to city: Asked by Hafer to table it. Place as unfinished business.
Report out from Council Committee Meetings:
• Water Authority: Sibley- Pipe is fused all the way to the golf course. Everything going good.
Clerk Treasurer Lanter: Mailed Treasurer Report.
Director Sibley: Challenges of accepting lots at Central School-We spend more time and effort at the park. Prices have gone up and it takes away from other work. It will be low maintenance at first, turns into more responsibility for the city guys. We just took on a new bathroom at the park, now the new Kiosk.
Carlson- I understand why you don’t want it. People don’t see the behind the scenes. Do we have any other option on the West side? I have seen kids play there. Lon- Just giving my opinion on what will come.
Toombs- What about adding another employee? Lon- Once again, it’s money the city will have to spend.

Public Comment: Bednar- Malenowsky looked up what you asked earlier. Citations written were 362 last year, which seems low. You can reach out to Justice Court to see how many tickets come in and what the charge was. Fisher- we asked in the past and we got a big fat zero.

Law Enforcement: Undersheriff Bednar- Anthony Layboult, pleaded guilty to felony burglary from the Golf Course incident.
Had our first fentanyl overdose. Person survived.
A new hire will be sworn in on Friday March 8th. Will attend the academy on the 31st.
Mayor Jones:
• Staff reviewed Coal Board application, recommending we be funded for garbage truck. Vivirito-How much from the Coal Board? Mayor- $200,000.00
• Executive Forum was excellent. Several new Mayors. MMIA did a workshop for Law Enforcement. There was a PowerPoint for property tax and Government review process.
• Asking council to change the next meeting date to the 18th. Jeremy Fadness can’t make it on the 19th. Carlson and Vivirito can’t make it the 18th. Erickson isn’t sure he will be there either. Council agrees to possibly wait until April meeting to discuss subdivisions. The next meeting will be held on the 19th.
Attorney Brooks:
• On street parking ordinance #482: Re-worded somewhat and re-arranged somethings. Needs to be advertised for next meeting. Public Hearing on the 19th.
• Next Tuesday Mayor, Bruce and I will attend the meeting in Harlowton. Will look at similar things we have to deal with.
• Follow-up on request for local Building Permits.
Correspondence: Vivirito read an email from Dave Picchioni on Golf Course update. When new water is here, would it be possible to run pipe from existing wells to Golf Course? Mayor- Lon is not here to answer questions. Will discuss with him.
Unfinished Business;
• Subdivision Regulations: Mayor Jones- Please review the draft from Jeremy Fadness. Bruce suggested a soil study. Will go to Planning Board.
• Green Oil Field Subdivision: Will be reviewed at the same time as the Subdivision Regulations. Moved to April meeting.
• Central School site plan, amend plat, donation to city: Tabled.
• Planning Grants/CIP/Housing Inventory Grant: No update.
Report out from Council Committee Meetings:
• On Street Parking Ordinance #482: Carlson-How and who is going to track 7-day period? Mayor Jones-It’s Bruce’s job, he can track it. He knows where they are at. He can site with a compliance letter. Going to be hard to enforce. Carlson-Will the violations go through the Sheriff’s Office? Mayor Jones- Citations from Brent through Adam Larsen. Carlson- How do we keep tabs on how many are issued? How do we track them? Attorney Brooks- I propose that Mayor Jones, Bruce, Adam and I come up with a program to keep track of violations and how it will be enforced. Mayor Jones- It’s the job of the Council to make laws, not enforce them. I have the authority to write citations, I will if I have to. Long-Any info on towing of recreational vehicles? Where will they go? Mayor Jones-It’s a process, they have to be taken apart. We don’t know what the recreational vehicle is being used for, drugs, meth, no idea. Cost is expensive. Long- Can we budget for removal? Mayor Jones- I will email Brent with stuff to ask at Harlowton meeting. The ordinance goes into effect 30 days after second reading. It is important to be noticed up. Now we need a date. When do you want it to go into effect? Fisher- I say give 90 days to the public. Toombs- January 1st of next year. Six or seven months to give more time. Long- Longer period of time is a good idea, June of 2025. Carlson- I think waiting for better weather is good, do it before winter. If we go longer, they will use the excuse it’s cold or snowy. I say, August 1st. Erickson agrees with August 1st. Council is good with August 1st. Mayor Jones-It will give people enough time to respond. August 1st it is. Attorney Brooks-I will send it to Adam Larsen to see if he has suggestions. Toombs-Can we get a clean copy for the next meeting? Attorney Brooks- Both versions will be sent, a clean copy and a marked-up copy.
• Refuse District: Mayor Jones-Looking for recruits. Need someone in the city to serve on the board if anyone is interested. Theresa, maybe you can help me. Theresa-I would be happy to, we can discuss at the RCP meeting. Fisher- also looking for a Secretary/Treasurer.
• Dump: Fisher-The gentleman we hired is 7ft tall, the building is 5ft. The shack is unfit. We are looking at building or buying a shed to place by the front gate. They also need a bathroom. Will discuss at beginning of the fiscal year. Toombs- you might want to check out the new building at the racetrack. Fisher-Strange things happen at the dump, we had a guy bring bags of human poop. We are taking care of that issue.
• Monumental sign: Mayor Jones-Sign was placed at the new restroom. I will get a thank you card for Signal Peak and Frontier Sandstone.
• Lights at the park: Vivirito-Talked to Mike Mihalovich. Parts are in, if done by April 20th that would be great. Will start April 5th. Fergus Electric will drill the holes for poles.
• Mayor Jones- No app yet for Pool Manager.
Assistant Clerk Mann: Four Does and 2 Bucks reported for this year’s hunt. Adams- How many tags were sold? Mann- 50. Vivirito- How many dog tags so far for the year? Mann- not many, gets fewer and fewer each year.

Public Comment: Troy Evans-Thank you for working on the Street Ordinance, it’s overdue. The seven-day period, how will that work with the parking on the boulevard and sidewalk every day? Mayor-That is covered by a different ordinance.
Porche Club’s tentative date to visit Roundup is April 13th. Numbers may vary 20 to 50 cars, depending on weather. They plan on stopping at my studio then Coila’s studio. Mayor- I want to present them with a key to the city.
Concerning the Golf Course, why wouldn’t they hook into the new water? Mayor- I will check into the details.
